Children — Legitimation, Parental Power & Maintenance
A child born to a woman who is not married to the father is the lawful child of the mother under section 1546 of the Civil and Commercial Code. The father becomes the lawful father only by subsequently marrying the mother, by registering legitimation, or by court judgment, under section 1547, and registration of legitimation requires the consent of both the child and the mother under section 1548. Parental power is governed by section 1566 and the duty to maintain a child by section 1564.
