How the Thai visa system is actually structured
Thailand does not run a single points-based immigration stream. It runs a category system created by the Immigration Act B.E. 2522 (1979) and populated by ministerial regulations and Cabinet resolutions that are amended far more often than the Act itself. A visa is permission to travel to a port of entry; the immigration officer at that port grants the permission to stay, and those two things carry different dates. Almost every problem we are asked to unwind starts with an applicant who read the visa validity and ignored the admission stamp.
Categories divide into three practical families. Tourist and visa-exemption entries cover short leisure travel. Non-Immigrant categories, each identified by a letter code, cover a purpose: B for business and employment, O for family and retirement, ED for study, O-A and O-X for long-stay retirement, and the newer DTV for remote workers and soft-power activities. Above those sit privilege and investment routes such as the LTR visa administered through the Board of Investment and the Thailand Privilege membership programme, which behave less like visas and more like subscriptions with immigration benefits attached.
The letter code decides which extension rules apply once you are inside the country. This matters more than the initial application. A Non-B obtained for a job cannot be extended on retirement grounds without a change of category, and a tourist entry converted late gives an immigration office a discretionary reason to refuse. Choosing the code correctly at the outset is the single highest-value decision in a Thai immigration file.
Category map and where each one breaks down
Note the pattern in the right-hand column. Refusals in Thailand are overwhelmingly evidential rather than substantive. The applicant qualifies; the paperwork does not demonstrate it in the format the reviewing officer is required to tick. That is a solvable problem, and it is the part of the process we own.
| Category | Typical purpose | Where files usually fail |
|---|---|---|
| Visa exemption / TR | Leisure, short visits | Treating the 30/60-day admission as a right rather than officer discretion on repeated entries |
| Non-B | Employment, business meetings, work permit | Company documents older than the immigration office accepts, or capital-to-employee ratios not met |
| Non-O (spouse) | Marriage to a Thai national | Marriage registration abroad never recorded at the Thai district office |
| Non-O (retirement) | Age 50+, financial evidence | Seasoning of the bank balance not maintained for the required months before and after |
| O-A / O-X | Long-stay retirement issued abroad | Health-insurance certificate not on the prescribed form or not from a listed insurer |
| Non-ED | Study, language courses | Institution not authorised to sponsor, or attendance records below threshold at extension |
| DTV | Remote work, soft-power activity | Evidence of remote employment or course enrolment that does not tie to the applicant by name |
| LTR | Wealthy, pensioner, professional, skilled | Income evidence not covering the full qualifying period |
The document chain for a file prepared outside Thailand
- Establish the category first: Confirm the purpose of stay and the extension route you intend to use twelve months from now, not just the entry you need next month.
- Collect civil documents at source: Birth, marriage, divorce and police records must come from the issuing country. A photocopy certified locally is not the same as a certified extract from the registry.
- Legalise in the country of origin: Until 28 February 2027 a foreign public document intended for Thai official use is endorsed by the Thai embassy or consulate in that country. An apostille alone is not yet operative for Thailand.
- Translate into Thai and certify: The Department of Consular Affairs certifies the translation. Names must match the passport transliteration exactly across every document in the bundle.
- File and track the admission stamp: On arrival, photograph the stamp and the TM6 record. Diary the permitted-to-stay date, not the visa expiry, and set the extension reminder 30 days before it.
What changes when you are already in Thailand
In-country changes of category are possible but constrained. Immigration offices generally require at least 15 to 21 days of permission remaining before they will consider a change, and some categories cannot be reached from a visa exemption entry at all. Where a change is not available, a short trip to a Thai mission in a neighbouring country is the orthodox route, and the mission's own local practice — not Bangkok's — governs what it will accept.
Annual extensions are granted by the Immigration Bureau, and every extension resets a compliance calendar: the 90-day address report under section 37(5) of the Immigration Act, the re-entry permit if you intend to leave, and for employment cases the work permit cycle that runs in parallel and on different dates. We map those four clocks onto one calendar at the start of the engagement because a lapsed re-entry permit silently cancels an otherwise valid extension the moment the holder boards a flight.
Common mistakes and how we avoid them
More questions we are asked
- Can I work remotely for a foreign employer on a tourist entry?
- The Working of Aliens legislation is drafted broadly and the safe position is that income-generating activity performed in Thailand needs an appropriate status. The DTV was created precisely to give remote workers a defensible category; we assess eligibility against your employment evidence.
- How far ahead should a retirement extension be prepared?
- Start at least three months out. The bank-seasoning requirement looks backwards, so a balance topped up the week before filing does not satisfy it.
- Does a previous refusal block a new application?
- A refusal is a fact in your history, not an automatic bar. What matters is whether the new file answers the reason for refusal on its face; we ask for the refusal notice before advising.
- Is a visa run still viable?
- Repeated land-border re-entries on exemption attract officer scrutiny and refusals of entry are recorded. If your plan depends on repeated entries, convert to a category that supports the stay you actually need.
- Do you handle both the visa and the underlying document legalisation?
- Yes. Most of the risk in a Thai immigration file sits in the civil-document chain rather than the visa form, so we prepare both in one workflow.

Frequently asked questions
- What is the DTV and who realistically qualifies?
- The Destination Thailand Visa is a five-year multiple-entry visa allowing stays of up to 180 days per entry, extendable once per entry by a further 180 days at an immigration office. It targets remote workers employed or contracted outside Thailand, freelancers with foreign clients, and participants in Thai soft-power activities such as Muay Thai training, cooking courses or medical treatment, and it requires evidence of at least THB 500,000 in available funds.
- How is the LTR visa different from the DTV?
- The Long-Term Resident visa is a ten-year visa administered by the Board of Investment for wealthy global citizens, wealthy pensioners, work-from-Thailand professionals and highly skilled professionals, and it bundles a digital work permit, a flat 17% personal income tax rate for the skilled-professional category and annual instead of 90-day reporting. The DTV is cheaper and faster but grants no work permit for Thai-sourced work and no tax privileges.
- Can I work in Thailand on a tourist or DTV visa?
- No — any work performed inside Thailand requires a work permit or an equivalent digital work authorization, regardless of where the employer or client is located. The DTV is intended for work delivered to foreign employers and clients; taking on Thai clients or a Thai employer requires switching to a Non-B or LTR pathway with proper authorization.
- What most often causes a Schengen or UK visa refusal from Thailand?
- The dominant causes are weak evidence of ties to Thailand, bank statements that show a sudden unexplained deposit shortly before filing, inconsistencies between the application form and supporting documents, insufficient or non-compliant travel insurance, and an itinerary that does not match the stated purpose. Refusals are recorded, so a re-application must directly address the refusal ground rather than simply resubmit the same file.
