Q1066. How do foreign court judgments (divorce, child custody) get recognized and enforced in Thailand?

Answered by the NYC Visa & Translation legalization desk

Legalizing a foreign judgment does not itself make that judgment recognized or enforceable in Thailand. Obtain a court-certified judgment and, where relevant, evidence of finality, service, and any related orders. Ask the responsible Thai embassy about authentication and legalization, then arrange a certified Thai translation acceptable to the receiving authority. Foreign civil judgments generally cannot simply be registered for automatic enforcement; fresh Thai proceedings may be necessary. Divorce recognition or civil-status recording can follow a different route from enforcing financial or custody orders. Have Thai counsel assess jurisdiction, applicable law, and the appropriate procedure, especially for children’s matters. A common pitfall is confusing document authentication with judicial recognition. Verify filing requirements with the relevant Thai court or district office before filing.
