Q1114. Do foreign prenuptial agreements require MFA legalization to be enforceable in Thailand?

MFA legalization alone does not make a foreign prenuptial agreement enforceable in Thailand, and it is not a universal requirement for every such agreement. First, establish where the marriage was or will be registered and which law governs the agreement. For a marriage registered in Thailand, Thai requirements concerning execution and entry of the agreement in the marriage register are especially important. Ask the district office what foreign-document authentication and Thai translation it requires, and have a Thai family-law lawyer assess enforceability. Complete consular and MFA legalization only where the receiving authority requires it. A common pitfall is assuming later legalization can cure failure to register a prenup when required. Verify filing requirements with the receiving district office before filing.
