Q1120. Must long-term real estate lease agreements executed by foreigners be legalized by the MFA?

Answered by the NYC Visa & Translation legalization desk

A foreign party’s involvement does not, by itself, make MFA legalization mandatory for a Thai real estate lease. For leases of immovable property exceeding three years, registration at the competent Land Office is generally needed for enforceability beyond three years. Ask that office about the lease’s form, Thai-language requirements, supporting identity documents, and any overseas signatures. Documents executed abroad, particularly powers of attorney or foreign corporate records, may need separate authentication, consular legalization, and translation under the applicable requirements. A common pitfall is legalizing an overseas lease and assuming this replaces Thai land registration; legalization does not register the lease. Verify registration and foreign-document requirements with the competent Land Office before filing.
