Q1144. Must foreign long-term property sub-lease agreements be MFA-legalized?

Answered by the NYC Visa & Translation legalization desk

Not automatically: signing a long-term sublease abroad does not, by itself, create a universal Thai MFA legalization requirement. Ask the receiving Land Office, court, or other authority whether it needs authenticated foreign signatures, a notarized copy, or a legalized power of attorney. For Thai immovable property, separately check registration requirements, the head lease’s subletting provisions, and any required consent; legalization cannot replace these. If authentication is requested, confirm the notarial, issuing-country, and Thai embassy steps, followed by any required Department of Consular Affairs processing and Thai translation. A common pitfall is assuming that an MFA stamp makes an otherwise unregistrable sublease enforceable for its entire stated term. Verify the document and registration requirements with the relevant Land Office before filing.
