Q1165. Do skilled labor employment contracts executed abroad require MFA legalization?

Answered by the NYC Visa & Translation legalization desk

An employment contract signed abroad does not automatically require Thai MFA legalization simply because it concerns skilled labor. Requirements depend on the visa, work authorization, occupation, and receiving authority. Ask the relevant Thai embassy, Department of Employment, or BOI office whether it requires the original contract, a certified copy, or a legalized translation. If legalization is required, confirm whether the employer’s signature must first be notarized and authenticated in the issuing country, followed by Thai consular certification and any necessary Thai MFA step. Check that job title, employer name, and employment dates match the application. A common pitfall is legalizing a foreign assignment contract when a Thai employing entity’s contract is required. Verify the requirements with the receiving authority before filing.
