FAQ

What does marriage consulting cover?
Pre-marriage due diligence, prenuptial planning, immigration pathway mapping (spouse visa in your home country + Non-O in Thailand), document strategy across 2 jurisdictions, and coordination with the Amphur.
Why not just register at the Amphur directly?
Cross-border marriages must satisfy BOTH countries' laws. Registration at a Thai Amphur without home-country recognition steps (affirmation, apostille, embassy stamp) can leave the marriage invalid abroad — blocking your spouse visa.
How long is a typical engagement?
Consulting: 1–3 sessions (2 weeks). Full-service marriage: 4–10 weeks depending on nationality, home-country recognition steps, and translation load.
Cost?
Fees depend on the documents, destination and urgency. Send your documents for a written quote after review — no prices are published. Any government or embassy fees are set by the authority; verify them directly before filing.

Deciding where to marry before deciding how

For a Thai–foreign couple, the choice of where to register is a legal decision with consequences for property, immigration and inheritance, and it is far cheaper to make deliberately than to correct later. Registering in Thailand produces คร.2 and คร.3, documents that Thai district offices, Immigration and banks read without hesitation. Registering abroad produces a certificate that Thailand will recognise, but only after legalisation and translation, and each subsequent Thai transaction repeats that friction.

Under the Civil and Commercial Code, marriage in Thailand is created by registration at a district office (อำเภอ or เขต). A ceremony, however elaborate, has no legal effect on its own. Couples regularly hold the ceremony first and register months later, which is fine, but it means the legal date of marriage is the registration date and any evidence built around the ceremony date does not establish marital status.

The affirmation of freedom to marry

  • The foreign partner obtains an affirmation or certificate of no impediment from their embassy in Bangkok, or from home-country authorities where the embassy does not issue one.
  • The affirmation is then translated into Thai and certified by the Department of Consular Affairs at the Ministry of Foreign Affairs before the district office will accept it.
  • Divorced or widowed applicants supply the decree or death certificate, legalised and translated, because the affirmation alone does not always evidence the end of a prior marriage.
  • Affirmations have practical validity windows; district offices decline stale documents, so the sequence is embassy, MFA, district office without long gaps.
  • Thailand's Apostille regime takes effect 28 February 2027; documents needed before that date follow the consular chain.

Property, prenuptial agreements and later consequences

Thai law distinguishes สินส่วนตัว, personal property owned before the marriage or received by gift or inheritance, from สินสมรส, marital property acquired during the marriage. The default rules under the CCC apply automatically unless the couple agrees otherwise. A prenuptial agreement can vary the property regime, but it must be made in writing, signed by both parties and two witnesses, and — critically — registered at the same time as the marriage registration. An agreement signed after registration does not achieve the same effect.

This registration timing is the single most consequential detail in Thai–foreign marriage planning, and it is the one most often discovered too late. Couples intending a prenuptial agreement must have the drafted, translated document at the district office on the day, not in preparation.

Our consulting sequence

  1. Jurisdiction review: Where to register, taking into account both partners' nationalities, future residence, property intentions and immigration plans.
  2. Document mapping: Exact list per embassy, since requirements differ significantly between missions in Bangkok, with the MFA step scheduled realistically.
  3. Prenuptial drafting: Bilingual drafting to CCC formalities, with the Thai text controlling and the English text prepared for the foreign partner's understanding.
  4. District office attendance: Accompaniment on registration day with interpreting, so the parties understand what is being signed and recorded.
  5. Post-registration pack: Certified translations of คร.2 and คร.3 with the legalisation chain completed for the foreign partner's home authorities and any visa file.

Common mistakes and how we avoid them

Signing a prenuptial agreement after the wedding
Register it simultaneously with the marriage; the timing is a statutory formality, not an administrative preference.
Assuming a temple or hotel ceremony creates a marriage
Only district office registration does. Plan the registration date deliberately.
Skipping MFA certification of the embassy affirmation
District offices require the Thai translation certified by the Department of Consular Affairs; the embassy document alone is not enough.
Leaving foreign recognition until years later
Complete the translation and legalisation of คร.2/คร.3 while the documents and the couple's schedule are fresh.

More questions we are asked

Can we register on the same day we collect the affirmation?
Only if the MFA certification of the Thai translation is already complete. In practice the embassy, MFA and district office steps occupy separate days.
Is a prenuptial agreement enforceable in Thailand?
A prenuptial agreement made in the statutory form and registered with the marriage is recognised under the CCC. Terms contrary to public order or to the parties' statutory duties are not.
Does marriage give the foreign spouse the right to own land?
No. Marriage does not create land ownership rights for a foreign spouse, and Land Department practice requires declarations about the source of funds.
Do we need an interpreter at the district office?
Where one party does not understand Thai, offices generally expect an interpreter, and it protects both parties' understanding of what is registered.

Frequently asked questions

How does a foreigner register a marriage in Thailand?
The foreign partner first obtains an affidavit of freedom to marry from their embassy in Thailand, has it translated into Thai and legalized by the Department of Consular Affairs, and then both parties register the marriage at any district office (amphoe) with passports and two witnesses. Since the Marriage Equality Act took effect on 23 January 2025, same-sex couples register on exactly the same basis.
Do we need an interpreter at the district office?
Yes in practice — most district offices require that a foreign party who does not read Thai be assisted by an interpreter, and many request that the interpreter present identification and sign the register. Some offices also expect a prenuptial agreement, if any, to be presented before registration, because a prenuptial agreement in Thailand is only valid when registered together with the marriage.
Is a Thai marriage recognized in my home country?
A marriage registered at a Thai district office is generally valid worldwide, but recognition procedures differ: many countries want the Thai marriage certificate and the Kor Ror 2 extract translated, legalized by the MFA and certified by their embassy before it is entered in their civil register. Some countries additionally require registration with their consulate within a set period.
How is a prenuptial agreement made enforceable in Thailand?
Under the Civil and Commercial Code a prenuptial agreement must be in writing, signed by both spouses and two witnesses, and registered with the marriage at the district office on the day of registration — an agreement signed afterwards is void as to property arrangements. It also cannot contradict public order or the rules on parental duties, so the drafting must be Thailand-specific rather than a translated foreign template.
