PDPA — Thailand's Personal Data Protection Act
The Personal Data Protection Act B.E. 2562 was published on 27 May 2019 and, after several postponements by royal decree, took full effect on 1 June 2022. A data controller needs a lawful basis under section 24 — consent is only one, alongside contract, legal obligation, legitimate interest, public task, vital interests and research. Sensitive data listed in section 26, including race, religion, criminal records, health and biometric data, requires explicit consent unless an exemption applies. A personal data breach must be notified to the Office of the Personal Data Protection Committee within 72 hours under section 37(4). Exposure includes administrative fines of up to five million baht and punitive damages of up to twice the actual damage under section 78.
