Power of Attorney Certification in Thailand

A power of attorney defines the agent’s powers. Check the recipient’s form, scope and witness rules before signing; six months or one year is not a universal validity period.

Certification scope and key checks

Distinguish general powers from a specific transaction such as a property sale or banking act. A required form may identify assets, the agent and limits. Signature certification does not expand the powers written in the instrument.

Confirm signers, additional witnesses and language before the appointment. Wait to sign where the form requires execution before a witness. Translation and onward certification should follow the recipient’s checklist, not assumptions based only on country.

Documents to prepare

  • Recipient-approved POA and transaction details
  • Principal’s identity document and agent details
  • Witness, language and certificate requirements

Procedure for this document

  1. Check the form and delegated scope
  2. Verify identity and the required signing method
  3. Provide the requested act and any specifically required onward certification

Overseas use: confirm the recipient’s route

Notarization is not required for every public record, and some uses need no onward legalisation. Confirm whether the recipient needs an original, copy, translation or specific certification before arranging MFA and embassy steps where applicable.

Thailand deposited its accession on 30 June 2026. The Apostille Convention is scheduled to enter into force for Thailand on 28 February 2027. Do not assume Thai Apostilles are available before then. Even after entry into force, document scope and treaty relations with the destination must be checked.

Questions before booking

When does the power of attorney expire?
Check its expiry, revocation provisions and the recipient’s transaction rules. Do not substitute a generic six-month or one-year period; a recipient may request a newly executed instrument.
Are MFA and embassy legalisation always needed?
No. Ask the recipient to confirm the certification, language and onward steps. Notarization, translation and legalisation are distinct; do not perform every step automatically.
How are fees and timing assessed?
After reviewing the form, copies, signers, language and onward steps, we provide a quote and indicative schedule before work. Authority queues and outcomes are not guaranteed.
What should I send before booking?
Send the record type, destination country, receiving authority and its checklist through a direct contact channel. Redact personal information unnecessary for the initial enquiry.
