FAQ
- Company registration vs BOI vs FBL — what's the difference?
- Company registration is the baseline (DBD, 7–10 days). BOI grants tax + visa privileges (4–6 months). FBL permits foreigners in restricted List 3 activities. Many firms hold BOI + FBL together.
- When can foreigners own 100%?
- Three routes: (1) BOI-promoted activities, (2) FBL List 3, (3) US–Thai Amity Treaty for Americans. Otherwise a 51% Thai partner is required.
- Is PDPA compliance mandatory for small startups?
- Yes — any business handling personal data, regardless of size. A formal DPO is only mandatory for large-scale sensitive-data processing. Entry package THB 45,000 covers essentials.
- Trademark vs copyright — what's the difference?
- TM protects names/logos on goods/services (10 years, renewable). Copyright protects creative works automatically (life + 50 years). Most businesses need both.
