The SMART Visa is a Thai long-stay category administered jointly by the Board of Investment, the Immigration Bureau and the Department of Employment, aimed at high-skilled professionals, investors, executives and start-up founders working in targeted industries. Its defining feature is that a qualified holder does not need a separate work permit for the endorsed activity, and the permitted stay runs up to four years with reporting relaxed from every ninety days to annually.

The gatekeeping happens before immigration ever sees the file. An applicant must first obtain a qualification endorsement from the relevant government agency confirming both the industry fits a targeted sector and the individual meets the skill, salary or investment criteria. Most refusals we are asked to rescue are endorsement failures dressed up as visa refusals, and the fix is evidential rather than legal.

Sub-categories run under letter codes: T for talent, I for investor, E for executive, S for start-up, and O for qualifying dependants. Each has its own evidentiary spine — an employment contract and salary evidence for T and E, capital deployment records for I, an incubator or accelerator endorsement for S. Mixing the evidence packs is the single fastest way to lose two months.

Evidence that carries weight with the endorsing agency

• Employment contract stating the position, the targeted-industry activity in concrete terms, and remuneration in figures the agency can test against its threshold.
• Company documents proving the Thai entity operates in an endorsed sector: objectives in the affidavit, BOI certificate where held, and revenue evidence rather than marketing claims.
• Professional credentials with certified translations — degree, transcript, professional licence, and letters from prior employers describing duties rather than titles.
• For investor applications, traceable proof of funds transferred into Thailand and applied to the qualifying entity, not merely a balance held offshore.
• For start-up applications, the incubator, accelerator or venture-capital endorsement letter, plus the deposit evidence and health-insurance cover the scheme requires.
• A police clearance certificate where the endorsing agency or the consulate requests it, translated and legalised on the chain appropriate to the issuing country.

Sequence we run

1. Sector and code triage: We test the role against the current targeted-industry list and choose the letter code deliberately. Applying under E when the evidence supports T is a common self-inflicted refusal.
2. Qualification endorsement: We assemble and file the endorsement pack with the responsible agency and respond to clarification requests, which frequently concern how the role advances technology transfer.
3. Visa issuance: With the endorsement letter, the applicant applies at a Royal Thai Embassy or Consulate, or through the One Stop Service Centre for Visa and Work Permit where in-country processing is available.
4. Digital work-permit equivalent: We complete the SMART Visa registration so the holder's authorisation to perform the endorsed activity is on record with the Department of Employment.
5. Annual maintenance: We diarise the annual report, monitor whether the endorsed employment or investment has changed, and re-endorse where the role materially shifts.

Where the SMART Visa is the wrong tool

If the employer is not in a targeted sector, the ordinary Non-Immigrant B plus work permit route is faster and more certain, even though it carries the four-Thai-employees ratio and the capital requirements that the SMART route avoids. If the applicant's income is foreign-sourced and the work is performed for clients outside Thailand, the Destination Thailand Visa is a better fit and needs no agency endorsement.

For very senior executives with high assured income, the Long-Term Resident visa can be the stronger option because it bundles a ten-year horizon and a digital work permit, and its criteria are tested on personal income and assets rather than on the employer's sector. Do I need a work permit with a SMART Visa?

How long is the stay?

Up to four years depending on the sub-category and the endorsement, with the permitted stay usually aligned to the employment contract or investment horizon.

Can my family join me?

Qualifying spouses and children can apply under the dependant category, and dependant spouses receive broader activity rights than under a standard Non-B dependant visa.

What if I change employer?

A material change requires a new or amended endorsement. Working for a new employer on an endorsement issued for the previous one puts your status at risk.

Is the targeted-industry list fixed?

No. It is revised by the Board of Investment from time to time, so we verify the current list at the date of filing rather than relying on an earlier edition.
