Q1067. What qualifications define a court-certified translator appointed by the Thai Ministry of Justice?

Answered by the NYC Visa & Translation certified translation team
Thailand's court-interpretation and translation system works differently from the sworn-translator systems in civil-law countries — there is no single national licence that makes a translator 'court-certified' for all purposes. The actual landscape: the Ministry of Justice maintains a registration system for interpreters and translators working in the justice process (criminal and civil proceedings), with registration categories by language; courts appoint interpreters per case from their own approved lists, and the Court of Justice runs its own interpreter examination and registration; and for written translations used as evidence, the court assesses the translator's competence case by case — a party's translation can be challenged, and the court may appoint its own translator where accuracy is disputed. What this means in practice: for litigation documents, use a translator with demonstrable legal-translation experience and be prepared for the opposing party to contest the translation; for justice-process interpreting (police interviews, court hearings), the interpreter must come from the court's or the Ministry of Justice's registered lists; and the Ministry of Justice registration is also relevant for translators certifying documents for official use. For commercial certification, the MFA's certification of a translator's signature remains the standard route for documents going to government offices. Confirm with the specific court or agency which translator qualification it requires for the proceeding at hand.
