Q1091. What telecom sector rules govern telecommunication business license translations?

Answered by the NYC Visa & Translation certified translation team
Telecommunication business licences in Thailand are issued by the NBTC (Office of the National Broadcasting and Telecommunications Commission) under the Telecommunications Business Act, in three types — Type 1 (resale/services without network), Type 2 (services to a limited group or with limited network), and Type 3 (facilities-based with own network) — with foreign ownership caps under the Foreign Business Act shaping the applicant structure. The translation flows: the foreign parent or partner's corporate documents, technical qualifications, and financial statements are translated into Thai for the licence application, with legalisation through the chain where required; and licence conditions and NBTC notifications are translated into English for the foreign partner's compliance team. Sector rules that affect translation: the application forms and the licence conditions are Thai legal documents — the English renderings for the foreign party must track the Thai text exactly because the Thai text binds; technical annexes (network diagrams, service specifications) are translated with all parameters preserved; and spectrum or numbering resources referenced in the licence are identified by their official designations. For Type 3 licences with spectrum, the auction and assignment documents add another layer. Practice points: NBTC filings have prescribed formats — confirm the current application requirements; compliance reporting (quality-of-service reports, interconnection filings) is in Thai with English summaries for the group; and for foreign-invested applicants, the Foreign Business Act analysis should be settled with counsel before the document set is prepared. Confirm the NBTC's current licensing requirements for the specific service type.
