Q1094. How to process petroleum and mining concession agreement translations?

Answered by the NYC Visa & Translation certified translation team
Petroleum and mining concessions in Thailand are state-granted instruments — petroleum concessions under the Petroleum Act (administered by the Department of Mineral Fuels) and mining concessions under the Minerals Act (Department of Primary Industries and Mines) — and the translation work surrounds the concession document, the work-programme commitments, and the joint-operating agreements between partners. The translation workflow: the concession and its conditions are Thai state documents translated into English for foreign partners, lenders, and parent companies — the concession's block coordinates, work obligations (exploration wells, expenditure commitments), and relinquishment schedule are the operative content and must be rendered exactly; the joint operating agreement (usually English, based on AIPN/OGML model forms) is translated into Thai for the Thai partner's governance and any regulatory filings; and technical reports to the regulator (exploration results, reserves reports, development plans) are filed in Thai with English versions for the partners. Points that matter: reserves and resources figures follow SPE-PRMS or equivalent classifications — the classification terms must be preserved; unitisation and farm-in agreements add layers where blocks are shared; and the fiscal terms (royalty, petroleum income tax, special remuneration benefit) are statutory and must be described per the Act's current version. Caution: concession obligations carry forfeiture consequences — the English translation of the work-programme conditions deserves senior review. Confirm current requirements with the Department of Mineral Fuels or DPIM for the specific instrument.
