Q1111. What bankruptcy rules govern corporate receivership document translations?

Answered by the NYC Visa & Translation certified translation team
Corporate receivership in Thailand runs under the Bankruptcy Act through the Legal Execution Department, and the translation work surrounds cross-border insolvency: a foreign insolvency proceeding with Thai assets, or a Thai receivership with foreign creditors. The governing facts: Thailand has not adopted the UNCITRAL Model Law on cross-border insolvency, so foreign insolvency orders have no automatic effect in Thailand — a foreign receiver or administrator seeking to act over Thai assets must work through Thai proceedings, and the foreign court orders and appointment documents are translated into Thai, certified, and legalised for that purpose. The document set: the bankruptcy or administration order, the receiver's appointment and powers, the creditor list and claim amounts, and the court's directions — all translated in full because the Thai court and the Legal Execution Department assess the receiver's authority from them. Translation points that matter: the receiver's powers clause defines what they may do with Thai assets — it must be translated exactly; claim amounts are transcribed with currencies preserved; and the Thai-side documents (the debtor's Thai corporate records, asset registers) are translated into English for the foreign proceeding. Practice points: foreign creditors filing claims in a Thai receivership must file within the statutory period with their claim documents translated and legalised — missing the deadline forfeits the claim; and the claim form follows the Legal Execution Department's prescribed format. Coordinate the translation set with the insolvency counsel handling the Thai side.
