Q1158. What environmental rules govern EIA and EHIA impact assessment translations?

Answered by the NYC Visa & Translation certified translation team
Environmental impact assessments in Thailand are governed by the Enhancement and Conservation of National Environmental Quality Act, with the Office of Natural Resources and Environmental Policy and Planning (ONEP) administering the review — and the EIA/EHIA distinction matters: EHIA applies to projects with severe potential impact (large-scale industry, infrastructure, projects in sensitive areas) with a deeper review process. The translation flows: for foreign project developers and lenders, the Thai EIA report's key content is translated into English — the executive summary, the impact findings, and the mitigation commitments are the operative content (the full technical appendices, often thousands of pages, are rarely translated in full); for Thai projects with foreign technical contributors, the foreign technical inputs are translated into Thai for the report. Rules that matter: the EIA's approval conditions (attached to the project's permission to proceed) are binding obligations — their translation must be exact because compliance is measured against them; the public participation records (the hearing summaries and the responses to comments) are part of the report; and the mitigation and monitoring commitments become the project's environmental compliance baseline. Practice points: the report's preparer must be a licensed EIA consultant (ONEP registers them) — the credentials are part of the document; for lender due diligence (equator principles and similar frameworks), the translated EIA is read against international standards; and the review timeline (months for EIA, longer for EHIA) drives the project schedule. Confirm ONEP's current requirements and the project's category before scoping the translation.
