Q1363. Are electronic signatures legally valid in Thailand?

Answered by the NYC Visa & Translation team

Yes. Thailand's Electronic Transactions Act B.E. 2544 (as amended) gives electronic signatures legal effect, provided the method used can (1) identify the signatory and (2) show the signatory's intention to accept the document's content, and (3) is reliable and appropriate for the purpose. Higher-assurance signatures using certificates from ETDA-licensed providers carry stronger evidential weight. Important exceptions: certain documents must still be made in writing or signed by hand under specific laws — for example, real-estate transactions that require registration with a government office, or wills. Each government agency also accepts different e-signature formats, so confirm with the receiving authority before signing. Our team checks whether your document can be signed electronically and which format the destination authority accepts. This is general guidance; requirements and fees change — always verify with the PDPC, ETDA, the Thai Customs Department, or the Department of Foreign Trade before proceeding.
