Financial Guarantee / Sponsor Affidavit Certification in Thailand
A guarantee is a contract under which the guarantor answers for the debtor's default. Under the Civil and Commercial Code it must be in writing to be enforceable. A notary certifies that the guarantor signed in person, not that the guarantor can actually pay.

Certification scope and key checks
Read the full scope: maximum amount, guarantee period and call conditions.
Some guarantees binding a spouse need spousal consent under s.1476 of the Code.
Foreign recipients may require a notarised signature followed by consular legalisation.
Documents to prepare
- Draft guarantee letter
- Guarantor's ID/passport
- Underlying debt document, e.g. loan or lease
Procedure for this document
- Review the liability scope
- Sign before a notary with witnesses
- Translate if needed
- Legalise if required
Overseas use: confirm the recipient’s route
Notarization is not required for every public record, and some uses need no onward legalisation. Confirm whether the recipient needs an original, copy, translation or specific certification before arranging MFA and embassy steps where applicable.
Thailand deposited its accession on 30 June 2026. The Apostille Convention is scheduled to enter into force for Thailand on 28 February 2027. Do not assume Thai Apostilles are available before then. Even after entry into force, document scope and treaty relations with the destination must be checked.
