Power of Attorney — Inheritance/Estate Administration Certification in Thailand
Heirs abroad can authorise someone in Thailand to file papers, receive court notices or deal with a land office, but many estate actions require a court-appointed administrator. A POA does not replace a court order.

Certification scope and key checks
Banks and land offices often ask for the administrator order or consent from all heirs.
If heirs must consent in an administrator petition, let a Thai lawyer draft the wording first.
Names of the deceased and heirs must be spelled identically across documents and translations.
Documents to prepare
- Death certificate
- Proof of heirship (house registration, birth/marriage certificates)
- Grantor passport
- List of relevant assets
Procedure for this document
- Ask a Thai lawyer whether a consent or POA is needed
- Draft matter-specific wording
- Sign before an accepted officer
- Translate and send the original to Thailand
Overseas use: confirm the recipient’s route
Notarization is not required for every public record, and some uses need no onward legalisation. Confirm whether the recipient needs an original, copy, translation or specific certification before arranging MFA and embassy steps where applicable.
Thailand deposited its accession on 30 June 2026. The Apostille Convention is scheduled to enter into force for Thailand on 28 February 2027. Do not assume Thai Apostilles are available before then. Even after entry into force, document scope and treaty relations with the destination must be checked.
Questions before booking
- Can the attorney sell inherited land straight away?
- Usually an administrator or heir transfer is needed first.
- Must every heir sign?
- It depends on the matter; consent of relevant heirs is commonly required.
- Is Thai embassy authentication needed?
- Many Thai recipients require it; check before signing.
- Are MFA and embassy legalisation always needed?
- No. Ask the recipient to confirm the certification, language and onward steps. Notarization, translation and legalisation are distinct; do not perform every step automatically.
- How are fees and timing assessed?
- After reviewing the form, copies, signers, language and onward steps, we provide a quote and indicative schedule before work. Authority queues and outcomes are not guaranteed.
- What should I send before booking?
- Send the record type, destination country, receiving authority and its checklist through a direct contact channel. Redact personal information unnecessary for the initial enquiry.
