Last Will and Testament Certification in Thailand

Certifying a signature does not make a will valid everywhere; validity depends on the legal form and the law where assets are located.

Certification scope and key checks

Thailand’s Civil and Commercial Code provides several forms of will, such as an ordinary written will with at least two witnesses, and some people cannot act as witnesses. Beneficiaries should not witness. A lawyer checks the form before signing.

Overseas assets such as bank accounts or land may be governed by that country’s law or need a separate will. Ask a lawyer there rather than assuming legalisation makes it effective.

Documents to prepare

  • Draft will and asset list
  • Testator’s ID or passport
  • Independent witnesses and any destination advice

Procedure for this document

  1. Check the form and witnesses
  2. Sign before witnesses in the chosen form
  3. Certify signatures, translate and legalise only as needed

Overseas use: confirm the recipient’s route

Notarization is not required for every public record, and some uses need no onward legalisation. Confirm whether the recipient needs an original, copy, translation or specific certification before arranging MFA and embassy steps where applicable.

Thailand deposited its accession on 30 June 2026. The Apostille Convention is scheduled to enter into force for Thailand on 28 February 2027. Do not assume Thai Apostilles are available before then. Even after entry into force, document scope and treaty relations with the destination must be checked.

Questions before booking

Can a beneficiary be a witness?
They should not. Under Thai law a witness or their spouse may lose the gift under that will; use independent witnesses.
Will a Thai will cover overseas assets?
It depends on the law where the assets are. A separate will is sometimes needed; check with a local lawyer.
Are MFA and embassy legalisation always needed?
No. Ask the recipient to confirm the certification, language and onward steps. Notarization, translation and legalisation are distinct; do not perform every step automatically.
How are fees and timing assessed?
After reviewing the form, copies, signers, language and onward steps, we provide a quote and indicative schedule before work. Authority queues and outcomes are not guaranteed.
What should I send before booking?
Send the record type, destination country, receiving authority and its checklist through a direct contact channel. Redact personal information unnecessary for the initial enquiry.
