Q1036. What are the attestation rules for translating foreign wills and testaments for Thai estate claims?

Answered by the NYC Visa & Translation certified translation team
Foreign wills for Thai estate claims are used in two settings: probate-style proceedings at the Thai court (appointment of an estate administrator) and direct claims at asset holders (banks, Land Department). The attestation chain: the will and the probate grant (or equivalent court order from the home country) are legalised through the home-country chain — notary or court certification, foreign ministry, Royal Thai Embassy — then translated into Thai and certified at the MFA (200/quoted on request per stamp). Critical points: the Thai court requires the full will translated, including attestation clauses and any codicils — a will with a later codicil translated without the codicil is a defective filing; where the home jurisdiction issues a grant of probate or letters of administration, that grant is the key document and must be translated with the will; and the death certificate, heir documents (birth and marriage certificates linking heirs to the deceased), and any renunciation documents form one coordinated translation set where names must be consistent throughout. For immovable property, the Land Department applies its own documentary standards and commonly requires the court appointment order before transfer. Holograph and foreign-form wills raise validity questions under Thai conflict-of-laws rules — that is a legal question for the handling lawyer, but the translation must preserve the will's form features (handwritten versus typed, witness provisions) accurately. Confirm requirements with the court or asset holder before commissioning.
