Q1131. What civil status rules govern marriage and divorce certificate translations?

Answered by the NYC Visa & Translation certified translation team
Marriage and divorce certificates are the most-translated civil status documents in Thai practice, and the rules differ by direction. Foreign certificates coming into Thailand: a foreign marriage certificate used for a Thai spouse visa, a dependent application, or property matters follows the full chain — home-country authentication, Royal Thai Embassy legalisation, Thai translation, MFA certification (200/quoted on request per stamp); a foreign divorce decree or certificate proving freedom to marry follows the same chain, and for a foreigner marrying in Thailand, the evidence of single status (embassy affidavit or home-country certificate) plus any divorce or death certificates of former spouses must all be in the legalised, translated set — the district office checks the complete marital history. Thai certificates going abroad: the Thai marriage registration (Kor Ror 2 certificate and the Kor Ror 3 register extract) and divorce registration are translated into the destination language and certified at the MFA, then legalised by the destination embassy. Civil-status rules that matter: Thailand registers marriages at the district office — a religious ceremony alone is not a legal marriage, and the translation must describe the document's actual character (a marriage certificate from a temple is evidence of a ceremony, not of registration); divorce in Thailand is by mutual consent registered at the district office or by court judgment — the two documents differ and the translation must preserve which it is; and names after marriage or divorce (Thai practice on surname changes) must be tracked through the documents. Confirm the receiving office's exact requirements — district offices and foreign authorities each have their own checklists.
