Gift Deed / Deed of Gift Certification in Thailand

A gift of Thai immovable property must be in writing and registered with the land office (Civil and Commercial Code s.525). A notarised gift deed alone does not transfer title; a notary helps with POAs, copies and translations.

Certification scope and key checks

Gifts of money or movables complete on delivery, but overseas recipients such as banks may request a signed gift letter as source-of-funds evidence.

Tax and fees depend on relationship and value; check with the Revenue and Land Departments.

Donors abroad use the Land Department POA form.

Documents to prepare

  • Title deed or asset evidence
  • Donor and recipient ID/passport
  • Relationship proof if claiming tax relief
  • POA if delegating

Procedure for this document

  1. Identify the asset and recipient
  2. Check tax and fees with authorities
  3. Register at the land office for real property
  4. Translate and certify when a foreign recipient asks

Overseas use: confirm the recipient’s route

Notarization is not required for every public record, and some uses need no onward legalisation. Confirm whether the recipient needs an original, copy, translation or specific certification before arranging MFA and embassy steps where applicable.

Thailand deposited its accession on 30 June 2026. The Apostille Convention is scheduled to enter into force for Thailand on 28 February 2027. Do not assume Thai Apostilles are available before then. Even after entry into force, document scope and treaty relations with the destination must be checked.

Questions before booking

Does a notarised gift deed transfer land?
No; registration at the land office is required.
Do I need a gift letter to send money to my child abroad?
Some banks or countries ask; check with the recipient.
Can a foreigner receive Thai land as a gift?
Generally no; take legal advice first.
Are MFA and embassy legalisation always needed?
No. Ask the recipient to confirm the certification, language and onward steps. Notarization, translation and legalisation are distinct; do not perform every step automatically.
How are fees and timing assessed?
After reviewing the form, copies, signers, language and onward steps, we provide a quote and indicative schedule before work. Authority queues and outcomes are not guaranteed.
What should I send before booking?
Send the record type, destination country, receiving authority and its checklist through a direct contact channel. Redact personal information unnecessary for the initial enquiry.
