Prenuptial Agreement Certification in Thailand
Under Thai law a prenuptial agreement must be in writing before marriage registration, signed by both parties and at least two witnesses, and noted in the marriage register. Use abroad depends on that country's law.

Certification scope and key checks
Civil and Commercial Code sections 1465–1466: an agreement made after registration is not a valid prenuptial agreement. Bring it on the registration day at the district office or a Thai embassy.
If the foreign spouse will rely on it at home, local courts may require independent advice or asset disclosure; have a local lawyer review it first.
Documents to prepare
- Asset list for each party
- Passports or ID cards
- Two witnesses and a translation if a party cannot read Thai
Procedure for this document
- Draft and translate so both understand
- Sign with witnesses before registration
- Have it noted at marriage registration
Overseas use: confirm the recipient’s route
Notarization is not required for every public record, and some uses need no onward legalisation. Confirm whether the recipient needs an original, copy, translation or specific certification before arranging MFA and embassy steps where applicable.
Thailand deposited its accession on 30 June 2026. The Apostille Convention is scheduled to enter into force for Thailand on 28 February 2027. Do not assume Thai Apostilles are available before then. Even after entry into force, document scope and treaty relations with the destination must be checked.
Questions before booking
- Can we sign a prenup after marrying?
- Not as a Thai prenuptial agreement; it must be made before and noted at registration.
- Is a Thai prenup valid abroad automatically?
- It depends on the other country's law; get local legal review.
- Are MFA and embassy legalisation always needed?
- No. Ask the recipient to confirm the certification, language and onward steps. Notarization, translation and legalisation are distinct; do not perform every step automatically.
- How are fees and timing assessed?
- After reviewing the form, copies, signers, language and onward steps, we provide a quote and indicative schedule before work. Authority queues and outcomes are not guaranteed.
- What should I send before booking?
- Send the record type, destination country, receiving authority and its checklist through a direct contact channel. Redact personal information unnecessary for the initial enquiry.
