Statutory Declaration Certification in Thailand

A statutory declaration must follow the recipient country's form and law, such as Australia or the UK, which define who may witness it. Check whether a Thai notarial attorney qualifies or the embassy is required.

Certification scope and key checks

Australia uses the Commonwealth statutory declaration form and a list of authorised witnesses; the UK uses the Statutory Declarations Act 1835. Declarations made abroad may need a consular officer, so confirm with the recipient.

False declarations are offences under the recipient's law. The statements must be facts the declarant knows; we translate and explain the form, not supply facts.

Documents to prepare

  • Recipient's declaration form
  • Passport
  • Supporting documents referred to

Procedure for this document

  1. Check whether a Thailand-based witness qualifies
  2. Review content and declarant identity
  3. Sign before the authorised witness

Overseas use: confirm the recipient’s route

Notarization is not required for every public record, and some uses need no onward legalisation. Confirm whether the recipient needs an original, copy, translation or specific certification before arranging MFA and embassy steps where applicable.

Thailand deposited its accession on 30 June 2026. The Apostille Convention is scheduled to enter into force for Thailand on 28 February 2027. Do not assume Thai Apostilles are available before then. Even after entry into force, document scope and treaty relations with the destination must be checked.

Questions before booking

Can a Thai lawyer witness an Australian statutory declaration?
It depends on Australia's authorised-witness list; some cases need the embassy. Check the Attorney-General's Department.
How does it differ from an affidavit?
Affidavits are typically sworn for court proceedings; statutory declarations are out-of-court statements under specific legislation.
Are MFA and embassy legalisation always needed?
No. Ask the recipient to confirm the certification, language and onward steps. Notarization, translation and legalisation are distinct; do not perform every step automatically.
How are fees and timing assessed?
After reviewing the form, copies, signers, language and onward steps, we provide a quote and indicative schedule before work. Authority queues and outcomes are not guaranteed.
What should I send before booking?
Send the record type, destination country, receiving authority and its checklist through a direct contact channel. Redact personal information unnecessary for the initial enquiry.
