Q1041. What is the fundamental legal difference between traditional MFA document Legalization and an Apostille stamp?

Answered by the NYC Visa & Translation legalization desk
An Apostille replaces a traditional authentication chain when the Hague Apostille Convention applies between the document’s country of origin and its destination. Traditional legalization commonly involves authentication by the issuing country’s authorities followed by the destination country’s embassy or consulate. Both procedures authenticate signatures, official capacity, and seals; neither confirms that the document’s contents are true or legally sufficient for its intended use. First identify the issuing country, destination, and document type. Then check whether the Convention is in force between those countries and whether the document falls within its scope. A common pitfall is assuming an Apostille eliminates translation or receiving-agency requirements. Verify the applicable route with the relevant official authority before filing.
