Trademark Registration for Restaurants, Cafés and Food Brands in Thailand

Most restaurant owners think about trademarks only after the sign, the boxes and the social pages are done. The common problem is that someone else has already filed a similar name — Thailand generally grants rights to the first applicant. Checking the name before investing in signage and packaging is far cheaper than rebranding later.
Classes this business usually needs to consider
- Class 43 — Restaurant, café, bar and catering services — the core class for the venue name.
- Classes 29 and 30 — If you plan to sell packaged chilli paste, sauces, snacks or frozen food under the same name, consider goods classes as well.
- Class 32 — Bottled drinks or juices sold under the restaurant name.
Common problem areas
- Names that directly describe the food
- A name that simply says 'delicious noodles' is usually refused for lacking distinctiveness. Add a word or device that is genuinely yours.
- Personal or place names
- Province, district or personal names may be refused or require additional consent documents.
- Franchising and branches
- If you plan to franchise, file in the name of a clearly identified rights holder (person or company) from the start, so licence agreements can be made properly.
What to prepare before contacting the team
- The logo or name exactly as used in real life
- The list of food or products you sell, and products you plan to add
- Applicant name: individual or company, with identity documents
- Branch or franchise plans (if any)
Print signs and packaging only after the name search. FDA food registration numbers are a separate matter from trademarks.
The overall process
Search for identical and similar names and devices in the Department of Intellectual Property database → choose classes and draft the list of goods or services → file the application → the registrar examines and may issue office actions → publication for opposition → pay the registration fee. Timing depends on the Department's queue and any oppositions. Once registered, protection lasts 10 years and can be renewed. Registration is not guaranteed, and you should verify current details with the Department of Intellectual Property (ipthailand.go.th).
Frequently asked questions
Does a small single-branch restaurant need a trademark?
It is not mandatory, but if someone else registers the same name first, they may be able to make you stop using it. Filing prevents that and helps when you expand or sell online.
Should I register the Thai or English name?
Register the form actually used on your sign and packaging. If you use both languages regularly, they may be filed together or separately — the team can advise which gives wider protection.
