Trademark Registration for Supplements, Vitamins and Health Products in Thailand

The supplement market is highly competitive and full of similar names, and labels must pass the Thai FDA before sale. A trademark search should run in parallel with the FDA application — if the name conflicts with an existing registration, an FDA-approved label may still have to be reprinted.
Classes this business usually needs to consider
- Class 5 — Dietary supplements, vitamins and pharmaceutical preparations — the core class.
- Class 30 or 32 — If the line includes functional drinks or general health foods, consider additional classes.
- Class 35 — If you run your own retail or online shop selling multiple brands.
Common problem areas
- Names claiming effects
- Names that directly claim treatment or cure may be refused, and may also create problems under FDA advertising rules — check both angles before printing.
- OEM factory filings
- Some OEM factories file the brand in their own name. Check the contract and make sure the filing is in the brand owner's name.
- FDA number is not a trademark
- The FDA registration number authorises sale of the product; it gives no rights in the brand name. The trademark is filed separately with the Department of Intellectual Property.
What to prepare before contacting the team
- Brand name and logo as they will appear on the label
- Full product list, including planned additions
- OEM contract (if any)
- Export or cross-border sales plans
Health-product advertising is regulated separately from trademarks. Review both the registrability of the name and the advertising rules before committing to packaging.
The overall process
Search for identical and similar names and devices in the Department of Intellectual Property database → choose classes and draft the list of goods or services → file the application → the registrar examines and may issue office actions → publication for opposition → pay the registration fee. Timing depends on the Department's queue and any oppositions. Once registered, protection lasts 10 years and can be renewed. Registration is not guaranteed, and you should verify current details with the Department of Intellectual Property (ipthailand.go.th).
Frequently asked questions
Should I file the trademark or the FDA application first?
Run them in parallel. A trademark search early on avoids the situation where the FDA label is approved but the name conflicts with an existing mark.
Can a name that passed the FDA still be refused as a trademark?
Yes. The FDA and the trademark office apply different criteria. Passing one does not guarantee the other.
