Q1045. How to process international patent certificate translations for intellectual property protection in Thailand?

Answered by the NYC Visa & Translation certified translation team
Foreign patent certificates are used in Thailand for IP litigation, licensing deals, and technology-transfer due diligence — note that a foreign patent does not itself protect you in Thailand; protection requires a Thai or PCT national-phase application at the Department of Intellectual Property (DIP). The translation workflow: the patent certificate and, where relevant, the specification and claims are translated into Thai, certified, and legalised through the chain (home foreign ministry plus Royal Thai Embassy) when the receiving body requires legalisation — courts and the DIP's opposition proceedings generally do. Technical points: the claims are the legally operative part and must be translated by a translator with the relevant technical background — a mistranslated claim term can narrow or destroy the asserted scope in litigation; patent numbers, application numbers, and priority dates are transcribed exactly; and figures and chemical formulae are not translated but referenced. For licensing agreements filed with the DIP, the agreement translation must use terminology consistent with the patent translation. Timing: a certificate alone takes on a timeline confirmed after document review; a full specification with claims can take weeks depending on length and technical field. Confirm with the receiving body (court, DIP, or counterparty counsel) which parts of the patent document set it requires translated.
