Q1046. What are the steps for translating foreign trademark registrations for legal protection in Thailand?

Answered by the NYC Visa & Translation certified translation team
Foreign trademark registrations come into Thai practice in three situations: as evidence in opposition or cancellation proceedings at the Department of Intellectual Property (DIP), as supporting documents for a Thai application claiming convention priority, and in licensing or franchise due diligence. The translation steps: obtain a certified extract or certificate from the home trademark office (most offices issue these online now), legalise through the chain where required (home foreign ministry plus Royal Thai Embassy), translate into Thai, and certify at the MFA (200/quoted on request per stamp). Trademark-specific points: the mark itself is never translated — it is reproduced exactly, and the translation covers the certificate text, the goods and services specification (which must be rendered with Nice Classification class numbers preserved), and the status entries (renewals, assignments); where priority is claimed under the Paris Convention, the priority document must show the filing date and application number exactly, and the Thai application must match; and for Madrid Protocol international registrations designating Thailand, the WIPO extract in English is usually accepted by the DIP without full legalisation — confirm before paying for the chain. For litigation, the opposing party can challenge the translation, so use a translator experienced in IP terminology. Confirm the DIP's current documentary requirements before commissioning.
