Q1047. How to translate software copyright documents to prevent infringement in Thailand?

Answered by the NYC Visa & Translation certified translation team
Software copyright in Thailand arises automatically under the Copyright Act — there is no registration system — so foreign copyright documents are used as evidence of ownership and creation date in disputes, or in due diligence for software acquisitions. The documents typically translated: copyright certificates from countries that do register (US Copyright Office certificates, China Copyright Protection Center registrations), source-code deposit receipts, development agreements, and assignment agreements. The workflow: legalisation through the home-country chain where the receiving body requires it, translation into Thai, and certification. Practical points: a US Copyright Office certificate is strong prima facie evidence and its registration number and effective date must be transcribed exactly; for China registrations (common for software distributed in Asia), the CPCC certificate is in Chinese and follows the third-language chain (Chinese→English, MFA certification, plus embassy layer where required); and assignment agreements must be translated in full because Thai courts examine the chain of title — a gap between the developer and the claimant is a common litigation failure. For ongoing protection, the practical measures are contractual (licence terms, escrow) rather than documentary. If the goal is enforcement, coordinate the translation set with the handling IP lawyer so the evidence chain is complete before filing.
