Q1107. What trademark rules govern international trademark application translations?

Answered by the NYC Visa & Translation certified translation team
International trademark applications touching Thailand run through two channels: the Madrid Protocol (Thailand is a member — international registrations can designate Thailand) and direct national filings at the Department of Intellectual Property (DIP). The translation rules for each: Madrid designations of Thailand are processed by the DIP on the WIPO data — the mark and the goods/services list come through in English, and the DIP's examination works from that, so the translation need is minimal at filing (though office actions and responses are in Thai, needing translation for the foreign applicant); direct national filings require Thai application documents — the goods and services specification is filed in Thai following the DIP's accepted terminology, and the mark itself is reproduced exactly (word marks in foreign scripts are transliterated and translated in the application's data fields, which the DIP uses for examination). Rules that matter: the goods/services specification determines the scope of protection — the Thai rendering must match the commercial intent, and the DIP's classification practice (it examines class headings and specific items per its own guidelines) should be followed; priority claims under the Paris Convention (6-month window) require the priority document details exact; and for opposition or cancellation proceedings, foreign registration certificates follow the legalisation-plus-translation chain as evidence. Practice points: transliteration of foreign word marks into Thai script is a strategic choice (it affects how the mark is pronounced and searched in Thailand) — decide it deliberately; and keep the Thai and international portfolios' specifications aligned. Confirm the DIP's current practice with the handling trademark agent.
