Q1049. How to process multi-language real estate lease agreement translations for foreign tenants?

Answered by the NYC Visa & Translation certified translation team
Lease agreements for foreign tenants in Thailand are usually bilingual from the start — the practical translation question is which version controls. Under Thai practice, a lease for residential use can be in any language the parties choose, but for registration at the Land Department (required for leases over 3 years to be enforceable beyond 3 years), a Thai version or Thai summary is prepared for the registration, and the registered Thai text is what the Land Department record shows. The workflow for a foreign-language lease: translate into Thai, have both parties confirm the translation matches, and where the lease is registered, the officer checks the Thai version against the registration form. Points that matter: the rent, term, renewal options, and deposit clauses must be identical in both versions — discrepancies are construed against the drafter in disputes; the property description (title deed number, land office, area) must match the title deed exactly; and where the lease is to a company for residential use by its director, the parties' capacity should be clear. For condominium leases, the juristic person's rules may require a copy filed with the building. For long leases (30 years) and leases with superficies or usufruct structures, have a Thai lawyer review the Thai version before registration — the registered text governs. Translation of a standard residential lease takes on a timeline confirmed after document review.
