Q1135. What legal standards govern prenuptial agreement translations for family courts?

Answered by the NYC Visa & Translation certified translation team
Prenuptial agreements in Thailand are governed by the Civil and Commercial Code (Sections 1465–1469), and the rules are strict in ways that decide whether the agreement survives. The governing law: a prenuptial agreement must be in writing, signed by both parties and two witnesses, and registered at the district office at the time of marriage registration — an agreement not registered with the marriage is void; the agreement cannot contravene public order or good morals; and the spouses' property relations after marriage follow the agreement within those limits. The translation situation: where one spouse is a foreigner, the agreement is prepared bilingually (Thai plus the foreign spouse's language) — the district office registers the Thai text, and the foreign-language text is the foreign spouse's evidence of what they signed; the translation must be exact because the agreement's clauses (separation of property, management rights, debt allocation) will be read against the Thai text in any later dispute. Points that matter: clauses that work abroad may fail in Thailand — provisions governing property in foreign jurisdictions, or attempting to opt out of Thai mandatory rules, need Thai family-law counsel's review before signing; the foreign spouse should receive the translation before the signing date, not at the district office counter; and foreign prenuptial agreements used in Thai proceedings (a couple married abroad with a foreign prenup) follow the legalisation chain into Thai, with the translation preserving the agreement's governing-law clause. Practice points: allow 2–4 weeks for drafting, translation, and review before the registration date; and keep the registered original safe — the district office's registration is the proof of existence. Coordinate with Thai family counsel before finalising any cross-border prenuptial arrangement.
