Q1136. How to process intercountry adoption petition translations for legal guardianship?

Answered by the NYC Visa & Translation certified translation team
Intercountry adoption in Thailand is governed by the Child Adoption Act and administered by the Department of Children and Youth (DCY), with the Hague Adoption Convention framework for convention countries — and the document translation volume is among the largest of any family-law process. The document set from the foreign applicants: home study report, birth and marriage certificates, employment and financial evidence, medical certificates, police clearances, and the adoption agency's credentials — all legalised through the chain (home-country authentication, Royal Thai Embassy legalisation), translated into Thai, and certified for the DCY file. The Thai-side documents going abroad (for the foreign court's finalisation or the child's immigration): the Thai court's adoption order, the child's Thai birth certificate, and the DCY's reports are translated into the destination language and certified at the MFA. Points that matter: the home study is the assessment core — it is translated in full (often 20–40 pages) because the DCY's social workers read it; the child's documents must be consistent (birth certificate, any prior guardianship orders, the abandonment or consent documents) — inconsistencies halt the process; and the process is long (commonly 1–2 years), so document validity windows must be managed — police clearances and medical certificates expire and are refreshed. Practice points: work through an agency authorised for Thai intercountry adoption — the DCY maintains the list; and for guardianship arrangements short of adoption (foster care, kinship care), the document set differs. Confirm the DCY's current requirements and the receiving country's immigration rules for adopted children before beginning.
