Q1161. How to process military and defense industry cooperation agreement translations?

Answered by the NYC Visa & Translation certified translation team
Military and defense cooperation agreements carry a threshold question before any translation begins: classification. Thai defense documents and most foreign defense documents carry security classifications, and classified material cannot leave authorised channels — the first step is confirming with the owning authority that the document is cleared for translation and through what channel. For cleared documents (procurement contracts for non-sensitive equipment, training cooperation agreements, unclassified technical manuals), the translation rules: the agreement's security clauses (the classification handling, the disclosure restrictions, the end-use undertakings) are the operative restrictions — translated exactly because they bind the handling of everything else; the technical specifications in procurement contracts follow military standards (MIL-STD, STANAG, or national equivalents) with the standards' terminology preserved; and the offsets and industrial participation clauses (common in defense procurement) are commercial text with defined obligations. Points that matter: export control regimes (ITAR, EAR, and other countries' equivalents) restrict where defense technical data may go — the translation itself may be a controlled transfer, and the translator's nationality and location can matter; the end-user certificates and end-use undertakings are legalised documents with their own chain; and the government-to-government agreements underlying commercial contracts are usually not translatable at all. Practice points: use translators with security clearances where the authority requires them; handle the documents under the required controls (secure premises, no cloud tools); and confirm the classification and handling requirements with the owning authority before any work begins.
