Penetration Testing + Vulnerability Assessment (Web / API / Mobile / Cloud)

Penetration Testing + Vulnerability Assessment (Web / API / Mobile / Cloud) · § Advisory
Quick Answer
Scoping + ROE · recon → exploit → post-exploit · manual + automated (Burp Pro, Nessus, MobSF) · OWASP-style report + CVSS 3.1 · retest after fixes.
Timeline: Scoping 1 wk · pentest 2–4 wk · report 1 wk · retest 1 wk.
Official fee: No state fee · tool licences (Burp Pro $449/yr, Nessus $3,990/yr) bundled · CREST/OSCP-certified testers add 25–40%.
Legal Basis
PDPA §37 · Cybersecurity Act 2019 §56 (CII annual risk assessment) · BoT IT Risk Management Notification 2021 · SEC IT Governance · OWASP Top 10 2021 · OWASP API Top 10 · OWASP MASVS · NIST SP 800-115 · PCI-DSS 4.0 Req 11.4.
Who Needs This
Any company with web/mobile · fintechs (BoT-mandated) · e-commerce > THB 10M · SaaS pursuing SOC 2/ISO 27001 · government agencies.
Required Documents
- Signed ROE + get-out-of-jail letter
- Asset inventory + IP whitelist
- Test credentials (unauth + user + admin)
- Executive summary (non-technical, 5 pages)
- Technical report (CVSS + PoC + remediation, 40–120 pages)
- Retest attestation letter.
Common Pitfalls
- Pentest without ROE = violates CCA §5–7 · tester risks jail.
- Scanner alone ≠ pentest · auditors reject · manual exploitation + business logic testing required.
- Peak-time production testing = downtime · maintenance window + rollback needed.
- No retest after fixes = auditor rejects · SOC 2/PCI need clean reports.
Typical Use-cases
- Digital bank · web + mobile + API + AWS · CREST-cert · BoT annual
- Fashion e-commerce · web + payment · PCI-DSS ASV scan + pentest
- Hospital · HIS + patient portal · HIPAA + PDPA · authenticated pentest
- SaaS · pre-SOC 2 · pentest report as CC7.1 evidence.
FAQ
- How often to pentest?
- PCI-DSS: yearly + after major change · SOC 2: yearly · BoT CII: yearly · best: quarterly automated + annual manual.
- Black box vs white box?
- Black = zero knowledge · white = source + creds · grey = middle · SaaS/API: grey recommended.
- Can bug bounty replace pentest?
- No · bug bounty = continuous · pentest = scoped + formal report · auditors require pentest.
- Tester liability?
- ROE + E&O insurance USD 1–5M · in-scope + safe = no liability · out-of-scope = liability.

Frequently asked questions
- Can a foreigner own 100% of a Thai company?
- Generally no for activities listed in the Foreign Business Act, where majority foreign ownership requires a Foreign Business Licence, a BOI promotion, or treaty rights such as the US–Thailand Treaty of Amity. Manufacturing and certain export activities are largely open, and BOI-promoted activities can permit full foreign ownership together with land-holding and visa privileges, so the right structure depends on the specific activity.
- What is the minimum registered capital for a Thai company?
- There is no general statutory minimum for a Thai-majority company, but practical thresholds apply: THB 2 million of paid-up registered capital per foreign work permit, or THB 1 million if the foreigner is married to a Thai national, and THB 3 million per foreign shareholder for a Foreign Business Licence. Capital should therefore be planned around the visa and work-permit outcome you need, not the incorporation minimum.
- How long does company registration take?
- Registration at the Department of Business Development can be completed within one to three working days once the name reservation, shareholder documents and company objectives are ready, and the VAT registration and social security registration follow afterwards. The realistic end-to-end timeline including bank account opening is two to six weeks, with the bank account usually being the slowest step for foreign directors.
- What ongoing accounting obligations does a Thai company have?
- Every Thai company must keep statutory accounts, file monthly withholding tax (PND 1, 3, 53) and VAT (PP 30) returns by the middle of the following month, file the half-year corporate income tax return (PND 51) and the annual return (PND 50), and have its financial statements audited by a Thai CPA and filed with the DBD each year. Dormant companies are not exempt — nil returns and an audited statement are still required.
